These Terms and Conditions ("Agreement") govern your access to and use of the ErrSol platform, website, mobile applications, software, products, services, features, content, communication tools, payment services, messaging systems, and all related technologies provided by ErrSol. By creating an account, accessing, browsing, registering, posting a service request, applying for jobs, accepting work, making payments, communicating with other users, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions. # ACCEPTABLE USE POLICY **Effective Date:** [Insert Date] **Last Updated:** [Insert Date] --- # 1. The purpose of this Policy is to maintain a safe, secure, lawful, professional, and trustworthy marketplace for everyone using ErrSol. By using ErrSol, you agree to comply with this Policy at all times. Failure to comply may result in warnings, suspension, permanent account termination, removal of content, cancellation of transactions, withholding of payments where permitted by law, or referral to law enforcement authorities. --- # 2. GENERAL USER RESPONSIBILITIES Every user agrees to: * Use the Platform honestly and lawfully. * Treat all users with dignity and respect. * Provide accurate and truthful information. * Respect intellectual property rights. * Protect confidential information. * Maintain account security. * Comply with all applicable laws and regulations. * Report suspected fraud or abuse. * Cooperate with investigations conducted by ErrSol. Users remain solely responsible for all activity conducted through their accounts. --- # 3. FRAUDULENT ACTIVITIES The following activities are strictly prohibited: * Creating fake accounts. * Using another person's identity. * Using stolen identity documents. * Uploading forged certificates. * Submitting false qualifications. * Falsifying work experience. * Manipulating verification processes. * Creating duplicate accounts to avoid restrictions. * Selling verified accounts. * Purchasing user accounts. * Assisting another person to bypass verification. Any attempt to deceive ErrSol or other users constitutes a material breach of this Policy. ErrSol reserves the right to permanently ban accounts involved in fraudulent activity without prior notice. --- # 4. ILLEGAL ACTIVITIES Users may not use ErrSol to facilitate or promote any unlawful activity, including but not limited to: * Human trafficking. * Forced labour. * Child labour. * Child exploitation. * Terrorism. * Financing terrorism. * Money laundering. * Drug trafficking. * Illegal gambling. * Smuggling. * Counterfeiting. * Identity theft. * Financial fraud. * Tax evasion. * Bribery. * Corruption. * Cybercrime. * Sale of stolen property. * Wildlife trafficking. * Environmental crimes. * Illegal immigration services. * Forgery. * Document fraud. ErrSol will cooperate with law enforcement agencies where legally required or reasonably necessary. --- # 5. HARASSMENT AND ABUSIVE CONDUCT Users shall not engage in conduct that intimidates, threatens, humiliates, or harms another individual. Prohibited conduct includes: * Harassment. * Bullying. * Stalking. * Blackmail. * Extortion. * Hate speech. * Discrimination. * Racist remarks. * Religious intolerance. * Sexual harassment. * Threats of violence. * Encouraging self-harm. * Doxxing. * Public shaming. * Intimidation. ErrSol maintains zero tolerance for abusive behaviour. --- # 6. PROHIBITED SERVICES The Platform may not be used to advertise, request, or provide services involving: * Illegal firearms. * Illegal weapons. * Explosives. * Illegal narcotics. * Counterfeit products. * Stolen goods. * Prostitution. * Escort services where prohibited by law. * Human trafficking. * Childcare performed unlawfully. * Medical procedures without licensing. * Unlicensed legal services. * Financial scams. * Pyramid schemes. * Multi-level marketing fraud. * Illegal investments. * Forged documentation. * Academic cheating services. * Examination fraud. * Sale of hacked accounts. * Cryptocurrency fraud. * Money mule activities. * Organ trafficking. * Wildlife trafficking. ErrSol may immediately remove such listings without notice. --- # 7. ACCOUNT SECURITY Users shall not: * Share passwords. * Share one account among multiple people. * Circumvent authentication systems. * Attempt unauthorized access. * Guess passwords. * Use credential stuffing. * Use stolen login credentials. * Access another person's account without authorization. * Create automated login scripts. Users must immediately notify ErrSol if unauthorized access is suspected. --- # 8. SYSTEM ABUSE Users shall not attempt to interfere with Platform operations by: * Hacking servers. * Reverse engineering software. * Modifying application code. * Scraping databases. * Mining confidential information. * Launching denial-of-service attacks. * Uploading malicious software. * Distributing ransomware. * Installing spyware. * Injecting malicious scripts. * Performing unauthorized penetration testing. * Exploiting software vulnerabilities. Any attempt to compromise Platform security may result in immediate legal action. --- # 9. PAYMENT ABUSE Users shall not: * Submit fraudulent chargebacks. * Use stolen payment cards. * Manipulate payment systems. * Circumvent service fees. * Launder money. * Process payments for third parties without authorization. * Misrepresent completed work to obtain payment. * Demand payments outside agreed arrangements where prohibited by Platform rules. ErrSol reserves the right to delay, suspend, or cancel transactions while conducting fraud investigations. --- # 10. CONTENT STANDARDS All content uploaded to the Platform must be lawful, accurate, respectful, and appropriate. Users shall not publish content that: * Is defamatory. * Is obscene. * Is misleading. * Violates privacy rights. * Infringes copyrights. * Contains malware. * Promotes violence. * Promotes terrorism. * Contains explicit sexual content prohibited by law. * Incites hatred. * Encourages criminal activity. * Contains confidential information without authorization. * Misrepresents qualifications or professional experience. ErrSol may remove content at its sole discretion without prior notice. --- # 11. INTELLECTUAL PROPERTY RESPECT Users must respect the intellectual property rights of others. Without proper authorization, users shall not: * Copy copyrighted works. * Upload pirated materials. * Use another person's logo. * Reproduce trademarks. * Misappropriate software. * Infringe patents. * Misuse confidential business information. ErrSol reserves the right to remove allegedly infringing content upon receiving a valid complaint. --- # 12. INVESTIGATIONS ErrSol reserves the unrestricted right to investigate suspected violations of this Policy. Investigations may include: * Review of account information. * Analysis of login history. * Examination of payment records. * Review of communications. * Device analysis. * IP address analysis. * Identity verification. * Cooperation with financial institutions. * Cooperation with regulatory authorities. * Cooperation with law enforcement. Users agree to provide reasonable cooperation during investigations. Failure to cooperate may result in suspension or termination of the account. --- # 13. ENFORCEMENT Where ErrSol determines that this Policy has been violated, the Company may take one or more of the following actions without prior notice where permitted by law: * Issue a warning. * Remove content. * Restrict account features. * Suspend messaging privileges. * Freeze payments where legally permitted. * Require additional identity verification. * Remove job postings. * Cancel transactions. * Suspend the account. * Permanently terminate the account. * Report unlawful conduct to authorities. * Pursue civil or criminal remedies. The specific enforcement action taken shall be determined at ErrSol's sole discretion based on the severity and nature of the violation. --- # 14. USER REPORTING Users are encouraged to report conduct that violates this Policy. Reports may include concerns relating to: * Fraud. * Fake profiles. * Identity theft. * Harassment. * Unsafe behaviour. * Illegal services. * Intellectual property infringement. * Payment fraud. * Security incidents. Submitting knowingly false or malicious reports may itself constitute a violation of this Policy. --- # 15. POLICY CHANGES ErrSol reserves the right to modify this Acceptable Use Policy at any time to reflect changes in technology, law, business operations, security requirements, or Platform functionality. Updated versions will become effective upon publication or as otherwise required by applicable law. Continued use of the Platform after changes take effect constitutes acceptance of the revised Policy. --- # 16. ACKNOWLEDGEMENT By using ErrSol, you acknowledge that you have read, understood, and agreed to comply with this Acceptable Use Policy. You understand that violations may result in immediate suspension or permanent termination of your account, removal of content, cancellation of transactions, and referral to law enforcement where appropriate. This Policy forms an integral part of the legal framework governing the ErrSol Platform and should be read together with the Terms and Conditions, Privacy Policy, Cookie Policy, Refund Policy, and Community Guidelines. If you do not agree with any part of these Terms, you must immediately discontinue your use of the Platform. These Terms constitute a legally binding agreement between you and ErrSol. --- # 2. OUR ROLE ErrSol is a technology platform whose sole purpose is to facilitate connections between independent clients seeking services and independent service providers offering services. ErrSol is **not**: * an employer; * a recruitment agency; * a staffing company; * a labor broker; * an employment agency; * a contractor; * a subcontractor; * an insurer; * a guarantor of work quality; * a mediator unless expressly agreed; * a representative of any worker or client. ErrSol merely provides technological infrastructure that allows registered users to communicate, negotiate, enter into agreements, and complete transactions independently. All agreements entered into between clients and workers are solely between those parties. ErrSol is not a party to any contract formed between users. --- # 3. ACCEPTANCE OF THESE TERMS By accessing the Platform, you certify that: * you are legally capable of entering into contracts; * you have reached the legal age required in your jurisdiction; * the information you provide is true; * you will comply with all applicable laws; * you understand that ErrSol may suspend or terminate your account for violations. Your continued use of the Platform after changes are published constitutes acceptance of those changes. --- # 4. DEFINITIONS For purposes of these Terms: **Platform** means the ErrSol website, applications, APIs, software, databases, communication systems, payment integrations, and related services. **Client** refers to any person or organization seeking services through ErrSol. **Worker** refers to any independent individual or business offering services through ErrSol. **User** means any visitor, registered member, client, worker, administrator, moderator, or any person accessing the Platform. **Content** includes text, photographs, videos, documents, reviews, ratings, logos, messages, audio, graphics, software, code, databases, and all uploaded materials. **Job** means any request, assignment, project, booking, or task posted by a client. **Payment** includes any money transferred through supported payment channels or processed via integrated payment providers. --- # 5. ELIGIBILITY To use ErrSol you must: * be at least eighteen (18) years of age or the legal age in your jurisdiction; * possess legal capacity to enter contracts; * not have been permanently banned by ErrSol; * not use the Platform on behalf of another person without authorization; * provide accurate registration information. ErrSol reserves the right to verify your identity at any time. Failure to provide requested identification may result in suspension or permanent removal. --- # 6. ACCOUNT REGISTRATION Users must create an account before accessing certain Platform features. You agree that all registration information shall be accurate, complete, current, and truthful. You shall not: * create fake identities; * impersonate another person; * use temporary or disposable identities for fraudulent purposes; * create multiple accounts to evade restrictions; * share your password; * allow another individual to operate your account. You are solely responsible for safeguarding your login credentials. Any activity occurring under your account shall be deemed your responsibility. ErrSol shall not be liable for losses arising from unauthorized use resulting from your failure to maintain account security. --- # 7. IDENTITY VERIFICATION To maintain trust and safety, ErrSol may require workers and clients to submit identity verification documents including but not limited to: * National Identification Cards; * Passports; * Driver's Licenses; * Utility Bills; * Selfie Verification; * Business Registration Certificates; * Tax Identification Documents; * Professional Licenses; * Work Permits. Submission of identification does not constitute approval or endorsement. ErrSol reserves absolute discretion to approve, reject, suspend, or revoke any account following review. Providing forged, altered, stolen, or misleading documentation constitutes fraud and may result in immediate account termination, forfeiture of funds where permitted by law, and referral to law enforcement authorities. --- # 8. INDEPENDENT CONTRACTOR RELATIONSHIP Every worker registered on ErrSol operates as an independent contractor. Nothing contained within these Terms shall be interpreted as creating: * employer-employee relationships; * partnerships; * joint ventures; * franchises; * agency relationships; * fiduciary relationships. Workers determine independently: * working hours; * pricing; * methods; * tools; * transportation; * assistants; * taxes; * insurance. Workers remain solely responsible for complying with all employment, tax, licensing, immigration, occupational safety, consumer protection, and business laws applicable within their jurisdiction. ErrSol does not supervise, direct, or control the manner in which services are performed. Accordingly, ErrSol bears no responsibility for wages, benefits, pensions, insurance, overtime, leave entitlements, workers' compensation, or employment-related obligations. --- # 9. CLIENT RESPONSIBILITIES Clients agree to: * provide truthful job descriptions; * maintain respectful communications; * pay agreed fees; * avoid discrimination prohibited by law; * refrain from posting illegal jobs; * provide safe working environments; * comply with applicable laws. Clients remain solely responsible for selecting workers. ErrSol does not guarantee that any worker possesses specific qualifications, licenses, certifications, experience, or competence beyond information voluntarily supplied by that worker. Clients are encouraged to conduct their own independent due diligence before hiring. --- # 10. WORKER RESPONSIBILITIES Workers agree that they shall: * perform services professionally; * possess all legally required licenses; * maintain insurance where required; * comply with health and safety laws; * complete work honestly; * avoid deceptive advertising; * protect client property; * maintain confidentiality. Workers shall be solely liable for damages resulting from negligence, fraud, misconduct, criminal acts, breach of contract, poor workmanship, property damage, bodily injury, or violation of applicable law. ErrSol expressly disclaims liability arising from such conduct. --- # 11. PLATFORM DISCLAIMER ErrSol makes no warranty, representation, or guarantee regarding: * the quality of work; * completion of projects; * worker competence; * client honesty; * payment reliability; * uninterrupted availability; * system accuracy; * platform security; * suitability of services. All services are provided "AS IS" and "AS AVAILABLE." Your use of the Platform is entirely at your own risk. ErrSol expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the maximum extent permitted by applicable law, ErrSol shall not be liable for indirect, incidental, consequential, punitive, special, or exemplary damages arising from or related to the use of the Platform. # TERMS AND CONDITIONS (Continued) # 12. PAYMENTS, FEES AND FINANCIAL TRANSACTIONS ErrSol may facilitate payments between Clients and Workers through integrated third-party payment providers. ErrSol is not a bank, financial institution, money transmitter, escrow agent, or payment processor unless expressly stated. Where payment services are offered through the Platform, all transactions remain subject to the terms and conditions of the applicable payment provider. The Platform may charge service fees, processing fees, convenience fees, subscription fees, verification fees, promotional fees, commission fees, withdrawal fees, or other administrative charges. Such fees may be modified at any time upon reasonable notice. Users agree that all fees displayed before completing a transaction are deemed accepted once payment is authorized. Unless expressly stated otherwise, all payments are final. Users are responsible for ensuring that sufficient funds are available before initiating any payment. ErrSol shall not be liable for payment failures caused by: * insufficient account balances; * expired payment cards; * incorrect account details; * banking system failures; * internet outages; * payment gateway downtime; * fraud prevention measures; * government restrictions; * sanctions; * force majeure events. Where applicable, ErrSol reserves the right to temporarily hold payments for fraud investigations, dispute resolution, identity verification, regulatory compliance, or security reviews. Nothing contained within these Terms obligates ErrSol to guarantee payment to any Worker or guarantee refunds to any Client. --- # 13. REFUND POLICY Refunds are granted solely at the discretion of ErrSol unless otherwise required by applicable law. Refund requests may be denied where: * services have already commenced; * services have been substantially completed; * false information was submitted; * payment disputes arise from user negligence; * users violate these Terms; * fraud is suspected; * chargeback abuse is detected; * identity verification fails. Users agree that disagreements regarding work quality are primarily disputes between the Client and Worker. ErrSol may, but is not obligated to, assist in resolving such disputes. Administrative decisions regarding refunds shall be final unless prohibited by law. --- # 14. TAXES Each Worker is solely responsible for determining, collecting, reporting, filing, and paying all applicable taxes, duties, levies, contributions, assessments, permits, licensing fees, pension obligations, social security obligations, value-added taxes, withholding taxes, income taxes, corporate taxes, and any other governmental charges. ErrSol assumes no responsibility for calculating or remitting taxes on behalf of users unless specifically required by law. Users agree to indemnify ErrSol against any governmental claims relating to unpaid taxes arising from their activities. --- # 15. USER CONTENT Users retain ownership of content they upload. By submitting any content to the Platform, users grant ErrSol a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to: * host; * store; * reproduce; * display; * modify; * resize; * translate; * publish; * distribute; * promote; * archive; * back up; * use such content for operating, improving, marketing, securing, and maintaining the Platform. Users represent and warrant that they possess all necessary rights to upload such content. ErrSol assumes no responsibility for verifying ownership before publication. Users remain solely liable for all uploaded content. --- # 16. PROHIBITED CONTENT Users shall not upload, publish, distribute, transmit, or otherwise make available any content that: * violates applicable law; * infringes intellectual property rights; * contains malware; * promotes terrorism; * promotes violence; * promotes hate speech; * promotes discrimination; * contains child exploitation material; * contains pornography prohibited by applicable law; * contains defamatory statements; * contains false reviews; * contains fraudulent advertisements; * impersonates another individual; * invades privacy rights; * distributes confidential information without authorization. ErrSol reserves the unrestricted right to remove any content without prior notice. --- # 17. MESSAGING SYSTEM The Platform may provide communication channels between users. Users acknowledge that messages may be monitored, filtered, logged, archived, or reviewed where reasonably necessary for: * fraud detection; * abuse prevention; * legal compliance; * dispute resolution; * platform security; * system maintenance. Users shall not use messaging systems to: * threaten; * harass; * blackmail; * extort; * solicit illegal activity; * distribute malicious software; * circumvent Platform rules. ErrSol may suspend messaging privileges without prior notice. --- # 18. REVIEWS AND RATINGS Clients and Workers may submit reviews based upon genuine experiences. Users shall not: * purchase reviews; * sell reviews; * manipulate ratings; * threaten users into positive reviews; * create fake accounts for ratings; * submit knowingly false feedback. ErrSol reserves absolute discretion to investigate and remove reviews deemed fraudulent, misleading, abusive, defamatory, or otherwise inconsistent with Platform standards. Ratings represent individual opinions and do not constitute endorsements by ErrSol. --- # 19. INTELLECTUAL PROPERTY All Platform software, source code, databases, graphics, layouts, logos, trademarks, trade dress, icons, photographs, documentation, interfaces, algorithms, workflows, audiovisual content, page designs, user interface elements, and proprietary technology remain the exclusive property of ErrSol or its licensors. Users acquire no ownership rights by using the Platform. Except with prior written authorization, users shall not: * copy; * reproduce; * modify; * reverse engineer; * decompile; * scrape; * mine data; * distribute; * sublicense; * sell; * lease; * exploit; * create derivative works from any portion of the Platform. Unauthorized use may result in civil damages, criminal prosecution, injunctive relief, and permanent account termination. --- # 20. PROHIBITED ACTIVITIES Users shall not directly or indirectly: * create fraudulent accounts; * impersonate another individual; * falsify identification documents; * circumvent security controls; * hack the Platform; * perform penetration testing without authorization; * distribute malware; * launch denial-of-service attacks; * scrape databases; * automate account creation; * interfere with servers; * overload infrastructure; * manipulate payment systems; * launder money; * finance terrorism; * engage in human trafficking; * advertise illegal goods; * sell counterfeit products; * solicit prostitution; * promote gambling where prohibited; * violate sanctions laws; * post illegal employment opportunities; * misuse personal data; * stalk users; * threaten violence; * harass employees; * upload viruses; * misuse APIs; * exploit software vulnerabilities; * interfere with investigations. Violation of this section constitutes a material breach of these Terms. ErrSol may immediately terminate offending accounts without prior notice. --- # 21. FRAUD PREVENTION ErrSol actively monitors Platform activity for fraudulent behavior. Users acknowledge that the Company may employ automated systems, artificial intelligence, manual investigations, identity verification procedures, device fingerprinting, behavioral analytics, IP monitoring, geolocation analysis, and transaction screening to detect suspicious activity. Where fraud is suspected, ErrSol may: * suspend accounts; * freeze balances; * delay withdrawals; * cancel transactions; * report activity to financial institutions; * cooperate with law enforcement; * preserve electronic evidence; * permanently ban offending users. Users waive any claim arising solely from reasonable fraud prevention measures undertaken in good faith. --- # 22. SECURITY Although ErrSol implements commercially reasonable security measures, no electronic system can be guaranteed to be completely secure. Users acknowledge the inherent risks associated with internet communications and electronic storage. ErrSol does not warrant that the Platform will always be free from unauthorized access, cyberattacks, data breaches, viruses, ransomware, spyware, phishing attempts, or other security incidents. Users are responsible for maintaining updated antivirus software, secure passwords, multi-factor authentication where available, and safeguarding their own devices. # TERMS AND CONDITIONS (Continued) # 23. ACCOUNT SUSPENSION AND TERMINATION ErrSol reserves the absolute and unrestricted right, at its sole discretion and without prior notice where legally permitted, to suspend, restrict, disable, investigate, or permanently terminate any user account for reasons including, but not limited to: * Violation of these Terms and Conditions; * Submission of false or misleading information; * Fraudulent or deceptive conduct; * Identity theft or impersonation; * Uploading forged or altered documents; * Criminal investigations or credible allegations of unlawful conduct; * Abuse of the Platform, employees, contractors, or other users; * Harassment, threats, discrimination, or hate speech; * Unauthorized access or attempts to compromise the Platform; * Distribution of malware, viruses, or harmful software; * Chargeback abuse or payment fraud; * Money laundering or terrorist financing concerns; * Breach of intellectual property rights; * Repeated complaints supported by credible evidence; * Activities that expose ErrSol to legal, financial, reputational, or operational risk. Suspension or termination may occur immediately where ErrSol reasonably believes such action is necessary to protect the Platform, its users, or the public. Termination of an account shall not relieve the affected user of any obligations incurred before termination, including payment obligations, indemnification duties, confidentiality obligations, or liabilities arising from previous conduct. ErrSol shall not be liable for any losses arising from lawful suspension or termination of an account. --- # 24. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, ErrSol, its owners, shareholders, directors, officers, employees, contractors, consultants, affiliates, successors, licensors, suppliers, business partners, agents, and representatives shall not be liable for any direct, indirect, incidental, consequential, exemplary, punitive, special, or economic damages arising from or relating to: * Failure of a Worker to perform services; * Poor workmanship or unsatisfactory results; * Delays in service delivery; * Missed appointments; * Property damage; * Personal injury; * Death; * Theft; * Fraud; * Misrepresentation; * Defamation; * Identity theft; * Cyberattacks; * Data breaches caused by third parties; * Payment gateway failures; * Internet outages; * Mobile network failures; * Government actions; * Force majeure events; * User negligence; * Unauthorized account access due to compromised credentials; * Lost profits; * Lost business opportunities; * Loss of goodwill; * Business interruption; * Corruption or loss of electronic data; * Third-party software failures; * Errors or omissions in user-generated content. ErrSol does not inspect, supervise, manage, direct, train, employ, or control Workers. Clients acknowledge that they independently select Workers based on their own judgment and assume all risks associated with such selection. Workers acknowledge that they independently accept assignments and remain solely responsible for how services are performed. The maximum aggregate liability of ErrSol for any claim arising under these Terms shall not exceed the total Platform service fees actually paid directly to ErrSol by the claimant during the six (6) months immediately preceding the event giving rise to the claim, unless a greater amount is required by applicable law. --- # 25. NO WARRANTIES The Platform is provided on an "AS IS," "AS AVAILABLE," and "WITH ALL FAULTS" basis. ErrSol expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to: * Merchantability; * Fitness for a particular purpose; * Non-infringement; * Availability; * Accuracy; * Reliability; * Performance; * Security; * Compatibility; * Continuous operation. ErrSol does not warrant that: * the Platform will be uninterrupted; * defects will be corrected; * servers will remain continuously available; * files will be free from viruses; * services will meet user expectations; * users will successfully obtain employment or workers; * payments will always process successfully; * communications between users will remain uninterrupted. --- # 26. INDEMNIFICATION Each user agrees to defend, indemnify, and hold harmless ErrSol, its owners, affiliates, directors, officers, employees, contractors, agents, successors, licensors, and representatives from and against any and all claims, actions, lawsuits, proceedings, investigations, liabilities, damages, losses, judgments, penalties, fines, settlements, expenses, and legal fees arising out of or related to: * breach of these Terms; * violation of applicable law; * negligence; * fraud; * intentional misconduct; * intellectual property infringement; * personal injury; * death; * property damage; * tax obligations; * employment disputes; * contractual disputes; * data protection violations; * defamatory statements; * uploaded content; * criminal investigations; * regulatory enforcement actions; * disputes between Clients and Workers. This indemnification obligation survives termination of these Terms. --- # 27. DISPUTES BETWEEN USERS ErrSol is not responsible for resolving disputes between Clients and Workers. Users are encouraged to resolve disagreements amicably. Where appropriate, ErrSol may, at its sole discretion, facilitate communication or provide administrative assistance. Such involvement shall not create any legal obligation to investigate, mediate, arbitrate, or determine the outcome of disputes. ErrSol's participation in dispute resolution shall not constitute an admission of liability or responsibility. Users remain solely responsible for enforcing any contractual rights against one another. --- # 28. FORCE MAJEURE ErrSol shall not be liable for any delay, interruption, or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to: * natural disasters; * floods; * fires; * earthquakes; * pandemics; * epidemics; * war; * terrorism; * riots; * civil unrest; * labor disputes; * governmental actions; * sanctions; * embargoes; * telecommunications failures; * internet outages; * cyberattacks; * power failures; * shortages of materials or personnel; * failures of third-party service providers. Performance shall be suspended for the duration of the force majeure event without liability. --- # 29. ELECTRONIC COMMUNICATIONS Users consent to receive communications electronically, including: * notices; * invoices; * payment confirmations; * account alerts; * security notifications; * legal notices; * marketing communications where permitted by law; * policy updates. Electronic communications satisfy any legal requirement that such communications be in writing. --- # 30. MODIFICATIONS TO THE PLATFORM ErrSol reserves the unrestricted right to: * modify services; * discontinue features; * introduce new functionality; * change pricing; * alter payment methods; * redesign interfaces; * update technologies; * suspend maintenance; * remove content; * improve security; * introduce new verification requirements. Such modifications may occur without prior notice unless required by law. --- # 31. GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ErrSol is incorporated or principally operates, without regard to conflict of law principles. Nothing in these Terms shall deprive consumers of mandatory legal protections available under applicable law. --- # 32. DISPUTE RESOLUTION Before commencing legal proceedings, users agree to make reasonable efforts to resolve disputes by contacting ErrSol through the official support channels. If informal resolution is unsuccessful, disputes may be submitted to mediation or arbitration where permitted by applicable law and agreed by the parties. Nothing in this section prevents ErrSol from seeking immediate injunctive relief to protect its intellectual property, confidential information, systems, or security. --- # 33. SEVERABILITY If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Any invalid provision shall be interpreted, to the greatest extent possible, in a manner consistent with its original intent. --- # 34. WAIVER Failure by ErrSol to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of ErrSol. --- # 35. ENTIRE AGREEMENT These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy, Acceptable Use Policy, Community Guidelines, and any additional legal notices published by ErrSol, constitute the entire agreement between the user and ErrSol regarding use of the Platform. They supersede all prior oral or written agreements relating to the same subject matter. --- # 36. SURVIVAL The following provisions shall survive termination of these Terms: * Intellectual Property; * Confidentiality; * Indemnification; * Limitation of Liability; * Payment Obligations; * Tax Responsibilities; * Dispute Resolution; * Governing Law; * Record Retention; * Any provision that by its nature is intended to survive termination. --- # 37. Users are responsible for ensuring that their account contact information remains current so that important legal notices and operational communications can be delivered. --- # ACKNOWLEDGEMENT BY CREATING AN ACCOUNT, ACCESSING THE PLATFORM, POSTING A JOB, APPLYING FOR WORK, MAKING A PAYMENT, OR OTHERWISE USING ERRSOL, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS. YOU FURTHER ACKNOWLEDGE THAT ERRSOL IS SOLELY A TECHNOLOGY PLATFORM FACILITATING CONNECTIONS BETWEEN INDEPENDENT CLIENTS AND INDEPENDENT WORKERS, AND THAT ERRSOL IS NOT THE EMPLOYER, AGENT, CONTRACTOR, GUARANTOR, OR LEGAL REPRESENTATIVE OF ANY USER.
